The following Terms and Conditions
cover the sale of goods from Systems
Direct (Bolton) Limited and do not
affect your statutory rights as a
consumer.
1. Definitions
1.1 ‘Systems
Direct’ means Systems Direct
(Bolton) Limited(Registered
Company Number
04631275) of 3 redshaw av,
bolton,bl2 3fz
1.2 The
‘Customer’ means the person who
buys or agrees to buy taps from
Systems Direct
1.3 ‘Goods’
means the taps supplied in
accordance with these Terms and
Conditions.
1.4 Tapsaver.co.uk is a
Web trading name of Systems
Direct (Bolton ) Limited
2. Prices
2.1 The
price of the Goods shall be that
specified on the tapsaver.co.uk
website and confirmed within the
order confirmation email.
2.2 All prices
specified are inclusive of VAT
but exclusive of delivery, which
will be displayed in the
shopping cart prior to the
Customer confirming the order.
3. Contract
3.1 Systems
Direct will email a Customer
confirming that an order has
been received. This email does
not indicate that a contract
exists between Systems Direct
and the Customer. Systems Direct
will indicate acceptance of the
Customers order, and hence a
contract between both parties,
when the Goods are despatched.
This has been included to
protect Systems Direct in the
case that a mistake has been
made in pricing, Goods have
inadvertently been under-priced,
or Systems Direct is no longer
able to supply a particular
product for some reason. In the
case of a change of price, the
Customer will be notified to
ensure that the price is
acceptable or given the
opportunity to cancel the order
and receive a full refund.
4. Payment
4.1 Systems
Direct will debit the Customers
credit/debit card with payment
in full for the Goods and
delivery charges on or after the
date of the Customers order.
4.2 If payment
is declined by the issuer of the
Customers credit or debit card,
Systems Direct will contact the
Customer to establish an
alternative means of payment
before authorising the despatch
of Goods.
4.3 When the
Customers order is placed,
credit card numbers are
encrypted using 128 bit
encryption. They are only
decrypted after they reach
Systems Direct. They are not
held in clear text on any
website.
5. Delivery
5.1 The
Goods will be delivered by a
nominated courier to the address
specified by the Customer, which
is detailed in the order
confirmation email.
5.2 Whilst
every reasonable effort shall be
made to deliver the Goods within
7 working days, time of delivery
shall not be of the essence and
Systems Direct shall not be
liable for any delay howsoever
caused. Please allow upto 14
days before you contact us about
delivery times. Please do not
order any item with the
expectation that it will be
delivered within 7 working days.
5.3 If the
Customer fails to take delivery
of the Goods at the address
specified in the order
confirmation email, or fails to
provide Systems Direct with
adequate delivery instructions,
then the Goods will be returned
to Systems Direct and the
Customer contacted. In this
instance, Systems Direct will
charge the Customer for
redelivery of the Goods.
5.4 Some Items are
delivered directly from the
manufacturer, please note that
you are bound by the terms of
the delivery from the
manufacturer.
6. Ownership and Risk
6.1 The risk
of loss or damage to the Goods
shall pass to the Customer upon
delivery of the Goods to the
address specified in the order
confirmation email.
6.2 Systems
Direct remains the owner of the
Goods until the Customer has
paid in full for such Goods.
6.3 The
Customer shall inspect the Goods
immediately upon receipt and
shall notify Systems Direct
within a reasonable time of
delivery (5 working days) . if the Goods are
damaged or do not comply with
the details presented in the
order confirmation email. If the
Customer fails to do this,
he/she is deemed to have
accepted the Goods.
6.4 Any Goods
in respect of which a claim of
defect or damage is made shall
be preserved by the Customer at
the Customers risk and retained
for a reasonable period to
enable Systems Direct to inspect
or collect the Goods.
7. Returns
7.1 Systems
Direct offers its Customers the
right to return all unwanted
Goods within 7 days after
delivery. Systems Direct will
refund the purchase price within
30 days, the only condition
being that the Goods have not
been used in any way and are in
the same condition as when
received by the Customer.
7.2 The
Customer should inform Systems
Direct when the Goods can be
collected within 7 days of the
delivery date. Systems Direct
will collect the Goods and
charge the Customer a collection
fee of £9.50.
7.3 In respect
of Goods that have been returned
due to a claim of defect or
damage, should the claim be
accepted by Systems Direct, then
the Customer will be offered
Goods in exchange or a full
refund. Should the claim be
unfounded, then the Customer
will be offered a refund minus
any reasonable costs incurred by
Systems Direct.
8. Privacy
8.1 Systems
Direct does not disclose
Customers information to third
parties other than when order
details are processed as part of
the order fulfilment. In this
case, the third party will not
disclose any of the details to
any other third party.
8.2 Cookies are
used on this website to keep
track of the contents of your
shopping cart. They are also
used after you have logged on as
part of that process. You can
turn off cookies within your
browser by going to 'Tools |
Internet Options | Privacy'
and selecting to block cookies.
If you turn off cookies, you
will be unable to place orders
or benefit from the other
features that use cookies.
9. General Terms
9.1 Every
effort has been made by Systems
Direct to ensure that no error
or omission has been made in any
website text, price list, order
confirmation email, or other
document, information or indeed
advice given by employees of
Systems Direct. In this respect,
correction shall be without any
liability on the part of Systems
Direct.
9.2 In the
event that Systems Direct is
prevented from carrying out its
obligations under a contract of
sale as a result of any cause
beyond its control such as, but
not limited to, Acts of God,
War, Strikes, Lock-outs, Flood
and Failure of third parties to
deliver goods, then Systems
Direct shall be relieved of its
obligations and liabilities
under such contract of sale as
long as such fulfilment is
prevented.
9.3 Except as
may be implied by law where the
Customer is dealing as a
consumer, in the event of any
breach of these Terms and
Conditions by Systems Direct the
remedies of the Customer shall
be limited to damages which
shall in no circumstances exceed
the price of the Goods and
Systems Direct shall under no
circumstances be liable for any
direct, incidental or
consequential damage.
9.4 The laws of
England shall govern the
contract between Systems Direct
and the Customer.
9.5 If any part
of these Terms and Conditions
that is fundamental is found to
be illegal or unenforceable,
such findings will not affect
the validity or enforceability
of the remainder of these Terms
and Conditions.
